2. Submitting a DMCA Takedown Notice

Notices that are incomplete or that do not meet these requirements may not be actioned.

4. How We Handle Takedown Notices
Upon receipt of a valid and complete DMCA takedown notice, Recall Times will:
- Acknowledge receipt of your notice within 3 business days
- Review the notice for completeness and validity
- Remove or disable access to the allegedly infringing content promptly if the notice is valid
- Notify the user who posted the content (if applicable) that it has been removed
- Provide the user with a copy of your takedown notice (with your personal contact details redacted where appropriate)
We reserve the right to reject notices that are incomplete, clearly fraudulent, or submitted in bad faith.
5. Counter-Notice Procedure
If you believe that content removed from Recall Times in response to a DMCA takedown notice was removed in error — or that you have the right to use the content – you may submit a counter-notice.
Your counter-notice must include:
- Your full legal name, email address, and postal address
- Identification of the removed content and the URL where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief that the content was removed as a result of mistake or misidentification
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Recall Times may be found), and that you will accept service of process from the person who submitted the original takedown notice
- Your physical or electronic signature

Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us within 10–14 business days that they have filed a court action, we may restore the removed content at our discretion.
6. Repeat Infringers
Recall Times operates a repeat infringer policy. Users or contributors who are found to have repeatedly infringed third-party copyright will have their access to the Website terminated.
7. Misuse of DMCA Notices
Please be aware that submitting a false or fraudulent DMCA takedown notice may expose you to legal liability, including damages and legal costs, under Section 512(f) of the DMCA. We reserve the right to pursue legal remedies against any person who submits a takedown notice in bad faith.
8. Fair Use & Government Data
Much of the recall data published on Recall Times is derived from official government publications, which are factual records and generally in the public domain or freely reproducible for public information purposes. We present this information in our own format with original writing and editorial structure.
We also note that reproduction of factual information — such as a product name, lot number, or hazard description — is generally not subject to copyright protection. Copyright protects original creative expression, not facts.
